The Salsarita’s Inc. 2011 Instant Win Game (the “Promotion”) consists of an Instant Win Game and Grand Prize Number Game.
1. PROMOTION PERIOD AND ELIGIBILITY: The Promotion starts on or about 2/16/11 and ends 3/16/11 (the “Promotion Period”), or when supplies of game pieces are exhausted, whichever occurs first. The Instant Win Game is open to legal residents of the 50 continental United States and the District of Columbia and Puerto Rico who are at least 18 years of age or older. Instant Win Prizes for cards received in Florida can ONLY be redeemed at participating locations in Florida. Instant Win Prizes for cards received in New York can ONLY be redeemed at participating locations in New York. The Matching Number Game is open to legal residents to legal residents of the 50 continental United States and the District of Columbia and Puerto Rico who are at least 18 years of age or older. Florida residents are eligible to win ONLY in Florida locations. New York residents are eligible to win ONLY in New York locations. Employees of Robust Promotions LLC ("Administrator") and Salsarita’s Inc. ("Sponsor") and Sponsor’s franchisees, subsidiaries, affiliates, sales representatives, distributors, advertising and promotion agencies, web masters and web suppliers and their respective IRS dependents, immediate family members (spouses, parents, children, and siblings and their respective spouses) and those living in the same household of each are not eligible to enter or win. All federal, state and local laws and regulations apply. By participating, entrants agree to these Official Rules.
2. TO OBTAIN A GAME PIECE: You will receive one game piece with any purchase at participating Salsarita’s Fresh Cantina locations, while supplies of game pieces last. OR, you may request a game piece without making a purchase by sending a self-addressed, handwritten, stamped envelope to: Robust Promotions LLC, 103 South Villa Avenue, Villa Park, IL 60181. You must include a 3 x 5 piece of paper on which you have handwritten "Salsarita’s Fresh Cantina IWG" and the address of your local participating Salsarita’s Fresh Cantina location. Game piece requests without this information (or mechanically produced requests) will not be honored. VT residents may omit return postage. Limit one game piece per request and one request per outer postmarked envelope. Free game piece requests must be postmarked by March 16, 2011 and received by March 23, 2011, while supplies last. Neither Sponsor nor Robust Promotions are responsible for lost, late, damaged, misdirected, illegible, incomplete or postage due mail/game piece requests. Any form of entry not stated in these Official Rules is void.
3. HOW TO PLAY:There are 2 games. The Instant Win Game, which is followed by the Matching Number game. One game piece allows you to play both games Menu Item Prize/Discount Game: To reveal your menu item prize/discount, gently scratch off the designated area of the game piece. If a prize message is revealed, you are the winner of the prize/discount indicated, subject to verification. If the game piece is blank or contains any other message, you are not a prizewinner. Grand Prize Number Game: During the Promotion Period, each game piece distributed will have a 6-digit number on the front of the game piece. Visit www.salsaritas.com between March 17, 2011 and April 13, 2011 to match the winning number randomly chosen and displayed on the website. If the number on your game piece matches the one on the website, you win the Grand Prize, subject to verification.
4. INSTANT WIN GAME PRIZES & DISCOUNTS/APPROXIMATE RETAIL VALUE (“ARV”)/ APPROXIMATE ODDS OF WINNING: A total of 306,000 game pieces are available for 63 participating Salsarita’s Fresh Cantina locations.. First Prize (30,500): Free Entrée w/chips, salsa & small drink after 4PM. Maximum Approximate Retail Value (“ARV”): $10.50. Odds: 1:10. Third Prize (91,500): Free Taco. ARV: $3.29 Odds: 3:10. Discount Prizes: Second Prize (91,500): $10 off any Take Home Value Pack. Odds 3:10. Fourth Prize (91,500): FREE Combo with the purchase of any entrée. Includes chips, salsa and small drink. Odds: 3:10. Total ARV of all Instant Win Game prizes combined is $621,285.00. For any prize that provides a free entrée or menu item, to the extent actual price of entrée or menu item is less than the stated ARV, the difference in prize value will not be awarded. Sponsor reserves the right to substitute a prize of equal or greater value should the advertised prize become unavailable. Prizes do not include alcohol, taxes or gratuities, which will be the responsibility of winner. Limit one food prize redemption per party per visit. ALL INSTANT WIN GAME PRIZES MUST BE REDEEMED BY THE CLOSE OF BUSINESS ON 4/13/11.
5. GRAND PRIZE NUMBER GAME/PRIZE: One (1) Grand Prize of $2,011 cash in the form of a check will be awarded. The total Approximate Retail Value of the Grand Prize to be awarded is $2,011. Odds of winning: 1:305,000. On or about March 17, 2011, one Grand Prize winning number will be selected in a random drawing from amongst all eligible 6-digit matching numbers available on the distributed game pieces by the Administrator, whose decisions are based on their sole discretion and interpretation of these official rules, and are final and binding in all respects. The winning number will then be revealed on www.salsaritas.com between March 17, 2011 and April 13, 2011. Grand Prize claim must be postmarked by 4/13/11 and received by 4/18/11. Grand Prize will only be awarded if game piece is properly redeemed and prize is properly claimed. Winner will be notified by overnight mail within ten (10) days upon receipt of winning game piece. Sponsor is not responsible for printing or typographical errors; incorrect or inaccurate registration information; late, lost, misdirected or incomplete prize claims; computer system or phone line errors, software / hardware malfunctions or other errors; or for failures or delays in transmissions that are human or technical in nature.
6. HOW TO CLAIM A PRIZE: To claim a Menu Item Prize/Discount: Present winning game piece before ordering on your next visit to a participating Salsarita’s Fresh Cantina location. Limit one food prize redemption per party per visit. Prizes must be redeemed at a participating Salsarita’s Fresh Cantina location by April 13, 2011. Prizes can not be combined with any other offers or discounts. No prize substitution, except at sole discretion of Sponsor. Prizes are not redeemable for cash and no change will be given. Prizes exclude alcohol, tax and gratuity. To claim Grand Prize: Hand print your full name, address (No P.O. Boxes) and telephone number on a 3” x 5” card, sign the back of the winning game piece and mail both to Robust Promotions LLC., Attn: Salsarita’s Fresh Cantina IWG Prize Claim, 103 S. Villa Avenue, Villa Park, IL 60181. You should use a traceable form of delivery and keep a copy of your entire submission, including the winning game piece. SALSARITA’S FRESH CANTINA EMPLOYEES ARE NOT AUTHORIZED TO VERIFY OR REDEEM CLAIMS FOR GRAND PRIZE. DO NOT GIVE YOUR GRAND PRIZE WINNING GAME PIECE TO AN EMPLOYEE. Only original game pieces will be accepted. Grand Prize claim must be postmarked by 4-13-11 and received by 4-18-11. Sponsor is not responsible for lost, late, stolen, damaged, incomplete, illegible, mutilated, or postage-due prize claims. If you do not have internet access, please call Robust Promotions directly for assistance at 1-630-834-2013. If the game piece contains the winning number, you will be provided with directions and information on how to claim your prize. Grand Prize Winner will be required to complete, sign, and return an Affidavit of Eligibility, a Liability Release and, where lawful, a Publicity Release (TN residents will not be required to sign a Release as a condition of winning a prize) within the time frame requirements stated in the notification letter. If documents are not returned within the time frame indicated in the notification letter, or if any prize notification or prize is returned as non-deliverable, or if the winner is found to be ineligible or not in compliance with these Official Rules, such prize may be forfeited and awarded to an alternate winner. The winner will receive instructions regarding the delivery of prize at a Salsarita’s Fresh Cantina or by mail, at Sponsor’s option No prize substitution, except at Sponsor’s sole discretion or otherwise provided herein. Sponsor reserves the right to substitute any portion of this prize with a prize of equal or greater value. Grand Prize is not transferable prior to award. The value of the Grand Prize is taxable as income and Grand Prize winner is solely responsible for any taxes on the Grand Prize, including, but not limited to all applicable federal, state and local taxes. Prize will not be fulfilled outside of the 50 United States and District of Columbia and Puerto Rico. If winner is a minor in his/her jurisdiction of residence, prize may be awarded in the name of, or to, winner's parent/legal guardian who must execute all documents and agree to all obligations and undertakings of winner, both on behalf of himself/herself and winner, or prize may be forfeited and awarded to an alternate winner. Game pieces have no cash value and cannot be sold or transferred. Game pieces are subject to verification and are void if copied, forged, altered or tampered with in any manner. For all prizes: All prizes that are properly claimed will be awarded. Unclaimed prizes will not be awarded. 7. LIMITATIONS: Game pieces will be void if they contain printing or other mechanical errors or are printed or produced in error or are otherwise irregular, or are not obtained through authorized, legitimate channels, or if any part is defective, illegible, altered, duplicated, photocopied, reproduced, forged, counterfeited, defaced, mutilated or tampered with in any way, or if they contain, or are the result of, a printing, seeding, typographical, digital, electronic, mechanical or other errors. Sole liability for any game pieces containing printing or other irregularities and/or errors, or which reveal illegible or unreadable game pieces are limited to replacement with free randomly selected game pieces while supplies last. Game pieces have no cash value, cannot be traded, sold, or bartered, and can only be used in a manner consistent with these Official Rules. If due to a production or other error there are more prize claims than prizes stated in these Official Rules, a random drawing will be held from among all eligible claimants in such prize category to award only the number of prizes stated in these Official Rules.
8. GENERAL CONDITIONS: By participating, participants agree to these official rules. All game materials (including prize claims) submitted become the sole property of Sponsor and will not be returned. Game subject to applicable federal, state and local laws. By entering, entrant agrees, that to release and hold Sponsor and Robust Promotions LLC and their respective subsidiaries and affiliates, harmless for any claim related to the acceptance of a prize or participation in this promotion. Acceptance of prize constitutes permission to use winner’s names and/or likenesses for advertising and promotional, except where prohibited or as restricted by law. All federal, state and local taxes on the Grand Prize are the sole responsibility of winners. The Grand Prize winner must report income to the Internal Revenue Service. In the event it is deemed during the verification process that such potential Grand Prize winner does not have a unique, personal and valid social security number for Sponsor to report the tax liability associated with acceptance of the prize, potential Grand Prize winner will be disqualified and an alternate winner may be selected. By participating in this Promotion, Entrants agree: [a] to abide by and be bound by these rules and decisions of Sponsor and judges which shall be final in all respects relating to the Promotion, including without limitation the interpretation of these rules; [b] to release, discharge and hold harmless Sponsor, its franchisees, licensees, subsidiaries, affiliates, advertising agencies, promotional agencies and suppliers and any other individual or company involved in the development or execution of the Promotion from any and all injuries, liability, losses, damages, rights, claims and actions of any kind including liability for personal injury or death resulting from their participation in the Promotion or their acceptance, use or misuse of a prize; and [c] if a winner, to the use of their name, voice, image and/or likenesses for advertising, publicity and promotional purposes by Sponsor and Sponsor’s subsidiaries and affiliates without further compensation (unless prohibited by law) and to execute specific consent to such use if asked to do so. Sponsor, its licensees, subsidiaries, affiliates, advertising agencies, promotional agencies and suppliers and any other individual or company involved in the development or execution of the Promotion and their respective directors, officers, shareholders and employees are not responsible and shall not be liable for [a] electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction; [b] unauthorized access to or alterations of entry materials; [c] technical, network, telephone equipment, electronic, computer, hardware or software malfunctions; and [d] limitations of any kind or inaccurate transmissions of or failure to receive information by Sponsor on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof.. Sponsor and / or Administrator are not responsible for lost, late, incomplete, incorrect, damaged, misdirected, or illegible entries or any condition caused by events beyond the control of the Sponsor that may cause the Promotion to be disrupted or corrupted. Sponsor may prohibit an Entrant from participating in the Promotion or winning a prize if, in its sole discretion, it determines that said Entrant is attempting to undermine the legitimate operation of the Promotion by cheating, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other Entrants, Sponsor, or Administrator. Entries which contain false information, are incomplete, inaccurate or are otherwise forged, defective, or made outside authorized channels, including those which have failed due to malfunction or failure of phones, phone lines, telephone systems or networks, or any combination thereof of any kind, any human error or otherwise, shall be void. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. If, for any reason whatsoever, this promotion, in Sponsor’s sole opinion, is not capable of running as planned, including, but not limited to, by reason of infection by computer virus, tampering, fraud, technical failures, or any other cause which, in the Sponsor’s sole judgment, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend this Promotion and limit entries to those submitted prior to the action taken, or to proceed in such a manner as may be deemed fair and equitable by Sponsor in its sole discretion.
9. WINNER’S NAME: For the name of the Matching Number winner, send a self-addressed stamped envelope, to be received by May 25, 2011, to Robust Promotions, Attn: Salsarita’s Fresh Cantina IWG List Request, 103 S. Villa Ave, Villa Park, IL 60181. Winner’s name will be sent after selection and verification of winner.
10. COPY OF RULES: These Official Rules are available in English and Spanish. In the event of a conflict between the two, the English version will govern. Rules are posted at all participating Salsarita’s locations or indiividul copy of rules, available at www.salsaritas.com.
